Юридическая конструкция цифрового профиля: понятие, признаки и границы правового режима
Аннотация
В статье рассматриваются сущностные черты цифрового профиля, позволяющие сформировать целостное мнение о его понятии и правовой природе. Актуальность исследования обусловлена активной фазой формирования и внедрения новых цифровых сервисов («Цифровое портфолио обучающегося», «Единый профиль молодого человека» на портале «Госуслуги», «Цифровой профиль иностранного гражданина» и др.), направленных на консолидацию данных о гражданах в отдельных сферах общественных отношений. Цель работы — определить понятие и правовой режим цифрового профиля и выявить перспективы его интеграции в систему публичного управления. На основе сравнительно-правового анализа нормативных актов установлено, что правовой режим цифрового профиля формируется на стыке законодательства о персональных данных, об идентификации и аутентификации, об образовании, о молодежной политике, трудового законодательства. Ключевыми элементами режима выступают добровольность формирования, децентрализованное хранение данных в ведомственных информационных системах, согласительный порядок доступа третьих лиц и целевое использование для персонализации государственных услуг. Выявлено, что на современном этапе отсутствует единый нормативный акт, закрепляющий понятие цифрового профиля, его правовой режим, гарантии защиты прав субъектов и механизмы контроля за использованием накопленных данных, что создает риски правовой неопределенности. Разработка такого акта будет способствовать институционализации цифрового профиля. Важным является принятие Указа Президента Российской Федерации от 09.07.2025 № 467 о создании цифрового профиля иностранного гражданина, который устанавливает прецедент нормативного закрепления механизмов внедрения цифровых профилей для отдельных категорий лиц. Перспективные направления институционализации цифрового профиля включают переход к проактивному оказанию услуг на основе данных профиля; формирование персонализированных образовательных и карьерных траекторий; создание единой платформы взаимодействия граждан с государством, работодателями и общественными институтами. Вместе с тем сохраняются проблемы защиты персональных данных, риски социального рейтингования и необходимость точного разграничения добровольного и обязательного использования профиля.
